General Release + Agreement
General Release
In consideration of my participation with Robert Goodland, "Goodland Horsemanship" and "The Heart of a Horse LLC", their animals and their affiliates, for a personal / professional Coaching consultation, seminars, workshops or lessons. I hereby generally release, waive, discharge and hold harmless Robert Goodland, "Goodland Horsemanship" and The Heart of a Horse LLC, their animals, their agents, employees, assistants, independent contractors and cosponsors and their affiliates, of any liability whatsoever related to my participation with "The Heart of a Horse LLC" event, for a personal / professional Coaching consultation, coaching session, seminar, workshop or lesson or to learn their training methods as well as any of their affiliates. I execute this release with the express intention of effecting any legal consequences provided by Wisconsin Civil Code, that is, the release of all liability associated with participating with Robert Goodland, "Goodland Horsemanship" and "The Heart of a Horse LLC", activities, programs, and events. This letter of agreement shall constitute the full and complete understanding between the parties and shall supersede any prior or contemporaneous representatives or agreements, oral, or written. This agreement shall be interpreted pursuant to and governed by the laws of the State of Wisconsin. If any action at law or equity is brought to enforce any of the terms of this agreement, the prevailing party shall be entitled to actual attorney's fees and costs. It is agreed that the venue for any such action at law is the City of Eau Claire and the County of Eau Claire, Wisconsin. No assignments of this agreement is permitted and any attempt to assign all or any rights, obligations or duties granted under this agreement shall be null and void.
I hereby completely release Robert Goodland, "Goodland Horsemanship" and "The Heart of a Horse LLC", their animals and their agents, employees, assistants, independent contractors and cosponsors and their affiliates, of any liability whatsoever related to my participation with this event on this or any other day.
"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release which if known to him must have materially affected his settlement with he debtor."
Robert Goodland, "Goodland Horsemanship" and "The Heart Of A Horse Gestalt Coaching" seeks and strives for safety at all times. However, I understand that there are certain risks inherent in the equine related activities. I acknowledge that all activities involving horses (including but not limited to: horseback riding, handling, leading, groundwork and other contact) involve this degree of risk.
Under Wisconsin law, an equine professional is not liable for any injury or death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to Section 895.481 of the Wisconsin Statutes. In consideration of the services of Robert Goodland, "Goodland Horsemanship" and "The Heart of A Horse LLC" their agents, owners, officers, volunteers, participants and all other persons or entities acting in any capacity on their behalf (herein collectively referred to as "The Heart of a Horse LLC"), I agree to waive and release forever all claims for damages against Robert Goodland, and "The Heart of a Horse LLC" for any and all injuries and/or losses that could be sustained while participating in "The Heart of a Horse LLC"'s program. I further understand that I am not covered by Robert Goodland, "Goodland Horsemanship" and/or "The Heart of a Horse LLC"'s insurance policy.
General Acknowledgment
I acknowledge that I have been given the opportunity to ask questions regarding any aspect of the release contained herein, and by signing below, I fully understand all aspects of the release and agree to these terms in their entirety. I hereby agree that should any legal proceedings arise relating to this general release and agreement, the disallowance of any term or condition will not prevent the legal enforcement of all other terms and conditions of said agreement. Having been so apprised, I hereby elect to and do assume all of the risk for claims heretofore or hereafter arising known or unknown, from this release and from my participation.
Photo Acknowledgment
Client/participant is aware that photos may be taken for promotion of Heart of a Horse services and events. No photos will be taken during private coaching lessons without Client/Participant knowledge.
Client Coaching Acknowledgment
I am aware that this is an experiential equine session featuring the Equine Gestalt Coaching Method.
I am aware that my practitioner is not a therapist, and that this is not a therapy session; that this is a coaching session. I accept that my coach may provide an insight and referral for me to seek therapy if they identify a need.
